PLEASE READ THIS CAREFULLY BEFORE USING ANY FACILITIES OR PARTICIPATING IN ANY ACTIVITIES AT AQUA IGNIS BATHHOUSE (“Facility”). BY ACCESSING OR USING THE FACILITY, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THE TERMS BELOW, WHICH AFFECT YOUR LEGAL RIGHTS.
Assumption of Risk: I acknowledge that use of the Facility - including but not limited to the hot rock aromatherapy sauna, herbal steam room, magnesium mineral bath, cold plunge, and Yin-Yang rest areas - involves inherent risks of injury, illness, or death. Such risks include, but are not limited to, those resulting from extreme heat or cold, slipping or falling, equipment malfunction, mechanical or electrical failure, and environmental conditions. I voluntarily assume all risks, whether known or unknown, arising from my use of the Facility and participation in any activities.
Waiver and Release: In consideration for being permitted to access and use the Facility, I, on behalf of myself and my heirs, executors, administrators, and assigns, hereby release, discharge, and hold harmless Aqua Ignis, its owners, operators, employees, contractors, agents, and representatives (collectively, “Released Parties”) from any and all liability for any injury, loss, or damage, including but not limited to personal injury or property damage, whether caused by negligence or otherwise, arising from or related to my use of the Facility.
Indemnification: I agree to indemnify, defend, and hold harmless the Released Parties from any claims, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising from my use of the Facility or participation in any activities, including any claims brought by third parties.
Medical Treatment: I acknowledge that Aqua Ignis does not provide medical services. I certify that I am in adequate physical condition to use the Facility and participate in its activities. In the event of an emergency, I consent to receive medical treatment deemed necessary, and I agree that I am responsible for any associated costs.
Safety Compliance: I agree to follow all posted rules, safety guidelines, and instructions provided by Aqua Ignis. I understand that failure to adhere to these guidelines may increase the risk of injury, and I assume full responsibility for any harm resulting from my non-compliance.
Governing Law and Jurisdiction: This Waiver shall be governed by and construed in accordance with the laws of New South Wales and any relevant federal Australian legislation. Any disputes arising from or related to this Waiver or my use of the Facility shall be resolved exclusively in the courts of New South Wales.
Severability: If any part of this Waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement: This Waiver constitutes the entire agreement between me and Aqua Ignis regarding the subject matter herein and supersedes all prior understandings, representations, or agreements, whether oral or written.
By purchasing entry to Aqua Ignis Bathhouse, I acknowledge that I have read and understood this Liability Waiver and Release of Claims, and I voluntarily accept and assume all associated risks. I understand that I am relinquishing significant legal rights, including the right to sue, and I sign this Waiver with full knowledge of its legal consequences.
All T's and C's above are applicable to members, further to this Aqua Ignis memberships provide recurring access to the bathhouse based on the membership tier selected. Memberships are intended for local patrons seeking a regular, ongoing bathing practice.
All memberships are subject to availability and capacity limits to ensure the space remains calm, spacious, and well held.
All memberships require a minimum commitment of three (3) months from the start date.
This minimum period allows time for a consistent ritual to form and ensures fairness across our community.
Memberships automatically renew for a further three (3) month period at the end of each term unless Aqua Ignis is notified otherwise in writing.
Renewals occur at the current membership rate at the time of renewal.
After the initial 3-month commitment, members may cancel their membership by providing a minimum of two (2) weeks’ written notice.
Cancellation requests must be submitted via email to Aqua Ignis.
Membership fees are not refundable for unused sessions or partial billing periods.
Membership sessions must be booked in advance and are subject to availability.
Sessions not used within a given week do not roll over.
Entry is valid only for the session type and days outlined in your membership tier.
Members must arrive on time for their booked session.
Memberships are strictly personal:
They may not be shared, transferred, gifted, or resold.
Entry is valid only for the named member.
At this time, memberships cannot be paused or placed on hold, except in exceptional circumstances at the discretion of Aqua Ignis management.
Aqua Ignis reserves the right to:
Adjust session schedules
Modify operational hours
Amend membership offerings with reasonable notice
Any changes will be communicated clearly and with care.
All members are expected to:
Follow bathhouse safety, hygiene, and conduct guidelines
Respect the shared nature of the space and other guests
Disclose any health conditions that may impact safe participation
Aqua Ignis reserves the right to suspend or cancel a membership if behaviour compromises safety or the experience of others.
By purchasing a membership, you acknowledge and agree to these terms and conditions.
